I like to thank everybody. The information is really good. Next (…) time I will use it for sure. Let me tell you how the story ended.

The real estate agent told us that the documents of the “Fiador” were almost okay. There is only a little formality at the “cartorio” missing, this will happen in 10 days. The agent told us to solve this problem by paying two months rent as a deposit. The owner, well the mother of the owner of the apartment, did not agree and she cancelled the deal. She paid a penalty and went to another agent. Until now she did not rent the apartment yet.

As far as I understand she lives in a stressful situation with her daughter (the owner) because of a cancelled marriage. The mother paid many things for the daughter and now she wants to be in control!

Well the positive thing is that in 19 days we are having all the documents which we need and they are already at the office of the agent. I hope she will help us with our quest!

Just as a rider to that, not only should the schedule of condition  be signed but also the backs of the photos, with dates. Approve

Exactly, because it´s not comun in Brazil to rent a furnished or partial furnished apartment or house in Brazil.

Even if the apartment or house has build in closets or a whole custom build kitchen, expect the owners or current tenent to ripp all out and take it with them.

As mentioned, make sure that the contract sates exactly what stays and what not, already BEFORE you move in.
And not the day you move in, when they usually make a final list that willstate all the furniture that stays as well as possible damaged that may exist when you move in.

It's not unreasonable for them to lease you an apartment without any cupboards or wardrobes (expecting the tenant to bring all their own storage furniture) as long as it's clear that this is how the apartment will be. 

I have a few apartments in Rio which I lease to tenants and one of them has no wardrobes in the bedrooms or cupboards in the kitchen (which is a simple granite pia with sink and tap) so it's quite a common thing in Brazil.

I will also pass by the real estate agent and discuss the situation with them. Maybe there is an attachment with the rent agreement for these kinds of things.

 
It is not so easy to find an apartment in SP for a Gringo (even with a Fiador) so I should be patient… I did not sign the contract yet and there is no deposit involved.

Don't take anything on trust.

Write everything down and take pictures (as has been mentioned above).

It is you that is going to be paying the rent so tell them what you want left in the apartment, you always have the choice of renting somewhere else.

When we first arrived and rented we took pictures of everything that looked odd and when we moved the owner tried to hit us with extra costs for broken items in the flat, we just sent copies of the pictures and written text that was signed by the agent to the owner and we never heard another thing.

When we brought the place we live in now we agreed with the owners what would be left and what they would take, we made a list and both signed it and when we moved in everything was as it should be.

It is your choice; you are the person paying so make sure you get what you want or find somewhere else.

I made an agreement with the jerk-off I bought my house from that anything screwed to the walls was part of the final sale price. Well he left the kitchen cabinets and the crappy shelves in the suite closet but he couldn't resit making off with the hardware (towel racks, TP dispensers, etc.) in the bathrooms. Forget about the light bulbs. Every time I take a shower I have to look at the holes in the tile left by the old shampoo rack. When I confronted him about it he gave me a dumb esperto smile, which in the end turned out to be pretty costly for him as he had not yet received his final payment.

I would be more concerned about what deposit you have to put down,

if they are taking the cupboards etc before you move in
 
what they going to hit you with when you leave  you have marked the paintwork lets keep your deposit.
 
look for somewhere else to rent if you have a fiador you should not have any  problems.
 
seems like they smell gringo money!

Always be absolutely clear on what is staying and what is going.  If you are buying (or renting) an unfurnished apartment you have to appreciate that the Brazilian definition of fixtures and fittings is subject to interpretation.  You may assume that fitted wardrobes and kitchen-units are an integral part of the apartment but that free-standing furniture is not.  Not necessarily!  When I first arrived in Brazil I went to view an apartment to buy and was impressed with the fitted furniture (cupboards, wardrobes) in the bedrooms and kitchen.  When the owner told me (and she made a point of stressing this) they were intending to take these with them I was incredulous. Not only would it have destroyed the walls (and probably the furniture by their removal) but they also had not bothered to check where and how it was exactly going to fit into their new apartment that was a totally different shape and size.  Apparently it's usual practice to do this in Brazil.  I did offer to buy them from her but for the same money she was asking I could have bought new and to a style of my preference.
